NOTICE PURSUANT TO ART. 13 OF LEGISLATIVE DECREE 30.6.2003 N. 196 AND ART. 13 OF EU REGULATION 679/2016
This notice describes the purposes and methods of processing personal data of individuals who, in various capacities, maintain a contractual and/or commercial relationship with LH s.r.l.
The provision of data by the Data Subject is not mandatory, except where necessary for the purposes set out below; in any case, it may be revoked at any time by the Data Subject through a simple written request addressed to the Data Controller.
DEFINITIONS
The “Data Controller” is LH s.r.l., represented by its legal representative pro tempore, with registered office in Via Ilaria Alpi 4, 46100 Mantova, Italy, Tax Code/VAT No. 02650200203 (hereinafter also referred to as “LikableHair”).
“Data Subjects” are the natural persons to whom the personal data processed by the Data Controller relate.
NATURE OF THE DATA PROCESSED
The Data Controller collects and processes the following categories of personal data:
- Data voluntarily provided by the Data Subject when contacting LikableHair.
- Data provided by the Data Subject for the conclusion of a supply, distribution, sales, consultancy, or any other type of contract with LikableHair, including by completing the supplier pre-qualification questionnaire.
- Data of the Data Subject that LikableHair may come into contact with in the course of activities necessary for the proper execution of existing contracts.
- Data provided by the Data Subject as part of recruitment and selection procedures at LikableHair.
- Images and videos collected and processed by LikableHair with the express consent of the Data Subject.
PURPOSES OF PROCESSING
The personal data communicated by Data Subjects will be processed by the Data Controller for the following purposes:
- to interact with the Data Subject and respond to requests for information or assistance;
- to perform the signed contract, as well as for sending communications about the product or service (including but not limited to commercial and administrative communications);
- to enable the Data Controller to carry out operations strictly related and instrumental to the proper management of relations with Data Subjects;
- to conduct statistical analyses in anonymous and aggregated form;
- to fulfil legal or regulatory obligations;
- to manage any complaints and allow the Data Controller to protect its rights;
- with the express consent of the Data Subject, to publish and/or disseminate images and videos on the website, social media profiles, or in publications for institutional, commercial, and/or informational purposes.
For purposes 1–6, providing personal data is a contractual obligation necessary for the conclusion of the contract or for the provision of requested services. Failure to provide such data will make it impossible to conclude the contract.
METHODS OF PROCESSING
Data will be processed lawfully, fairly, and in accordance with the principles of necessity, relevance, completeness, and proportionality with respect to the purposes pursued. The Data Controller will process the Data Subject’s data using IT methods suitable to guarantee data security and confidentiality, preventing unauthorized access, and retaining data only for as long as necessary to fulfil the purposes identified above.
Personal data processed for the purposes outlined will be retained for the duration of the contract and thereafter for any additional period required by law or regulation.
Processing will be carried out exclusively by personnel specifically authorized by LikableHair and by Data Processors appointed by the Data Controller.
For some processing activities, LikableHair may use third parties, who must comply with LikableHair’s instructions to ensure the security and confidentiality of the entrusted data.
To achieve the purposes set out above, the Data Controller may need to communicate the Data Subject’s personal data to third parties, including but not limited to: subsidiaries, parent and affiliated companies; parties performing technical and IT tasks on behalf of LikableHair; service providers for LikableHair’s IT system management; customer support providers; archiving and data entry providers; professional firms and consultancy companies; and market research firms commissioned by LikableHair. These third parties will process the data as Data Processors duly appointed by the Data Controller. The list of third parties is available at the registered office of the Data Controller.
Personal data processed for the above purposes will not be disclosed without authorization nor be subject to fully automated decision-making.
RIGHTS OF THE DATA SUBJECT
Each Data Subject may exercise, by written request to the Data Controller, the rights recognized under the GDPR, including but not limited to:
- the right of access to their personal data, obtaining confirmation of its existence, origin, purposes, and processing methods;
- the right to know the identity of the Data Controller and any Data Processors or DPO (where appointed);
- the right to know the recipients or categories of recipients to whom personal data has been communicated;
- the right to obtain the rectification of inaccurate data or completion of incomplete data;
- the right to erasure of personal data concerning them (under the conditions set out in Art. 17(1) GDPR and subject to the exceptions in Art. 17(3));
- the right to restriction of processing (in the circumstances outlined in Art. 18(1) GDPR);
- the right to request and receive their personal data in a structured, machine-readable format when processing is based on consent or contract and carried out by automated means (right to data portability);
- the right to object, on legitimate grounds, to the processing of their data;
- the right to object to processing for marketing, advertising, or market research purposes.
